gotaya Terms & Conditions

In these Terms and Conditions, the following definitions apply unless the context otherwise requires:

• "gotaya", "we", "us", or "our" refers to the gotaya platform and the entity operating it under a valid PAGCOR license in the Philippines.
• "Platform" means the gotaya website, mobile browser interface, and all related gaming and betting services accessible at gotaya.org.
• "Member", "you", or "your" means any individual who has registered a real-money account on the gotaya Platform.
• "Account" means the personal real-money gaming account held by a Member on the gotaya Platform.
• "Games" means all casino games, live dealer games, slot titles, bingo rooms, and any other gaming products available on the Platform.
• "Sportsbook" means the sports betting service offered through the gotaya Platform, including pre-match and in-play betting markets.
• "Bonus" means any promotional credit, free spins, cashback, or other incentive granted by gotaya to Members subject to applicable Bonus Terms.
• "PAGCOR" means the Philippine Amusement and Gaming Corporation, the regulatory authority that licenses and oversees online gaming operations in the Philippines.
• "PHP" or "₱" refers to Philippine Peso, the primary currency of the gotaya Platform.

References to a singular include the plural and vice versa. Headings are for convenience only and do not affect the interpretation of any provision.

2.1 Acceptance

By creating an Account on the gotaya Platform, you unconditionally accept these Terms and Conditions, our Privacy Policy, our Responsible Gaming Policy, and any Bonus Terms applicable to promotions you choose to participate in. These documents collectively form the entire agreement between you and gotaya.

In addition to the age requirement, you represent and warrant that:

• You are accessing the Platform from a jurisdiction where online gaming is lawfully permitted.
• You are acting on your own behalf and not as an agent for any third party.
• You are not a professionally trained player, employee, or contractor of gotaya, its affiliates, or any game provider whose titles appear on the Platform.
• You have not previously been self-excluded from gotaya or any other PAGCOR-licensed platform in a manner that remains active.
• The funds you use to fund your Account are from legitimate sources and are not proceeds of any criminal activity.

2.4 Territorial Restrictions

gotaya is a Philippines-focused Platform operating under PAGCOR licensing. Access from jurisdictions where online gaming is prohibited or restricted is not permitted. gotaya reserves the right to restrict access from any territory at its sole discretion, without notice and without liability.

3.1 Registration

To access real-money Games and the Sportsbook, you must register a single Account on the gotaya Platform. During registration, you are required to provide accurate, current, and complete personal information including your full legal name, date of birth, residential address, email address, and mobile number. gotaya reserves the right to request supporting documentation to verify any information provided.

3.2 One Account Policy

Each individual is permitted to hold only one Account on the gotaya Platform. Opening duplicate or multiple accounts — whether under the same identity or under different names or identities — is strictly prohibited. gotaya employs technical and manual detection measures to identify multiple accounts. Where duplicate accounts are identified, gotaya reserves the right to close all associated accounts, void any pending bets or bonuses, and withhold account balances pending investigation.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials, including your username and password. You must not share your Account credentials with any third party. gotaya will not be held liable for any loss or damage arising from unauthorised access to your Account that results from your failure to keep your credentials secure. You must notify gotaya immediately at [email protected] if you suspect any unauthorised use of your Account.

3.4 Know Your Customer (KYC) Verification

gotaya is required under PAGCOR regulations and applicable anti-money laundering laws to verify the identity of all Members before processing withdrawals and in other circumstances as required. You agree to provide any documents reasonably requested by gotaya for verification purposes, including but not limited to:

• Government-issued photo identification (passport, Philippine national ID, driver's licence, or SSS/UMID card)
• Proof of current residential address (utility bill, bank statement, or official government correspondence dated within 90 days)
• Proof of payment method ownership (e.g. screenshot of GCash or PayMaya account matching the registered name)
• Source of funds documentation if requested in connection with high-value transactions

Failure to provide requested KYC documents within a reasonable timeframe may result in suspension of withdrawal privileges or, in serious cases, Account closure.

3.5 Account Closure

You may request closure of your Account at any time by contacting gotaya support. gotaya reserves the right to close any Account at its discretion, including where a breach of these Terms has occurred, where fraudulent activity is suspected, or where required to do so by regulatory authorities. Upon closure initiated by you in good standing, any remaining verified balance will be returned to you via your registered withdrawal method after applicable KYC checks have been completed.

4.1 Accepted Payment Methods

gotaya accepts deposits and processes withdrawals exclusively through the following Philippine payment methods: GCash, PayMaya, BPI online banking, BDO online banking, and Metrobank online banking. All transactions are denominated in Philippine Peso (₱). gotaya does not accept deposits from payment methods not listed here, and does not process transactions in foreign currencies.

4.2 Deposits

Deposits are generally credited to your Account in real time or within a short processing window depending on the payment method selected. Minimum and maximum deposit limits apply and are displayed at the point of transaction. gotaya does not charge Members for deposits; however, your bank or e-wallet provider may apply their own fees, for which gotaya bears no responsibility.

4.3 Withdrawals

Withdrawal requests are subject to successful KYC verification and compliance review. gotaya endeavours to process approved withdrawal requests within one to three business days. Withdrawals will only be returned to the same payment method used for the original deposit, to the extent this is technically possible. gotaya reserves the right to request additional verification before processing any withdrawal request, particularly for first-time withdrawals or withdrawals exceeding defined thresholds.

4.4 Minimum Withdrawal

A minimum withdrawal amount applies and is displayed within your Account wallet section at all times. Requests below the minimum threshold will not be processed until the balance reaches the required minimum.

4.5 Anti-Money Laundering

gotaya operates in compliance with Philippine anti-money laundering regulations. We are obligated to report suspicious transactions to the appropriate authorities. Depositing funds and immediately withdrawing without meaningful gaming activity may be treated as a suspicious transaction pattern. gotaya reserves the right to freeze, withhold, or return funds and report activity to regulatory authorities where required by law.

5.1 General Bonus Terms

gotaya offers various promotional bonuses to its Members, including welcome bonuses, reload bonuses, cashback offers, free spins, and loyalty rewards. All bonuses are subject to specific Bonus Terms that are communicated at the time the promotion is offered. In the event of any conflict between these general Terms and Conditions and specific Bonus Terms, the specific Bonus Terms will prevail in relation to the relevant promotion.

5.2 Wagering Requirements

Bonus funds are subject to wagering requirements unless explicitly stated otherwise. Wagering requirements specify the total amount of eligible real-money bets that must be placed before bonus-derived winnings can be withdrawn. The applicable wagering requirement multiplier and eligible games will be clearly stated in the relevant promotion's terms. gotaya reserves the right to void bonus winnings where wagering requirements have not been met in accordance with the applicable Bonus Terms.

5.3 Bonus Abuse

gotaya actively monitors for bonus abuse. Actions that constitute bonus abuse include, but are not limited to: creating multiple accounts to claim the same promotion more than once; using low-risk or hedging betting strategies specifically designed to meet wagering requirements without genuine gaming engagement; and colluding with other Members to exploit promotional offers. Where bonus abuse is identified, gotaya reserves the right to void all bonuses and associated winnings and to close the Member's Account.

5.4 Expiry

Bonus funds and free spins expire after the period stated in the relevant Bonus Terms. Expired bonuses cannot be reinstated. gotaya is under no obligation to notify Members of impending bonus expiry, though it may choose to do so as a courtesy.

6.1 Game Rules

Each game available on the gotaya Platform is governed by its own set of rules, which are accessible within the game interface. Members are responsible for familiarising themselves with the specific rules of each game before placing real-money bets. In the event of a dispute regarding a game outcome, the game provider's server records shall be the definitive source of truth.

6.2 Sportsbook Betting Rules

All sports bets placed through the gotaya Sportsbook are subject to the applicable sports betting rules for each market, which are available within the Sportsbook section of the Platform. gotaya reserves the right to void, suspend, or settle bets at corrected odds where an obvious pricing error has occurred or where the integrity of a sporting event is in question.

6.3 Technical Errors and Malfunctions

In the event of a software malfunction, disconnection, or technical error during a game or bet, gotaya's policy is to void any affected round or bet and return the relevant stake to the Member's Account. gotaya shall not be liable for any losses, disruptions, or inconveniences caused by technical errors that are outside its reasonable control, including those arising from third-party game provider systems.

6.4 Prohibited Conduct

The following conduct is strictly prohibited on the gotaya Platform:

• Using any software, algorithm, bot, or automated system to gain an unfair advantage over the Platform or other players
• Engaging in collusion, chip dumping, or any form of coordinated cheating in multiplayer games
• Exploiting software bugs or errors rather than reporting them to gotaya support
• Using the Platform for any unlawful purpose, including money laundering or fraud
• Harassing, threatening, or abusing other Members or gotaya staff through any communication channel

gotaya reserves the right to immediately terminate any Account found to be engaged in prohibited conduct and to withhold associated balances pending investigation by the relevant authorities.

gotaya is committed to promoting responsible gaming among all its Members. Gaming on the gotaya Platform is intended solely as a form of entertainment and should never be used as a source of income or a means of addressing financial difficulties.

gotaya provides the following responsible gaming tools to all Members:

• Deposit Limits: Members may set daily, weekly, or monthly deposit limits through their Account settings. These limits take effect immediately when reduced and after a 24-hour cooling-off period when increased.
• Session Time Limits: Members may set maximum session durations after which the Platform will automatically log them out.
• Reality Checks: Periodic on-screen notifications reminding Members of the time and amount spent during a session.
• Self-Exclusion: Members may apply for a temporary or permanent self-exclusion from the Platform by contacting gotaya support. Self-exclusion requests are processed within 24 hours and cannot be reversed during the elected exclusion period.

All content on the gotaya Platform — including but not limited to text, graphics, logos, game assets, interface design, software, and trademarks — is the property of gotaya or its licensed content providers and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial entertainment purposes only.

You must not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the gotaya Platform without prior written authorisation from gotaya. Scraping, automated data collection, or reverse engineering of any part of the Platform is strictly prohibited.

9.1 Service Availability

gotaya does not guarantee that the Platform will be available at all times without interruption. Scheduled maintenance, emergency technical work, or circumstances beyond gotaya's control may result in temporary unavailability. gotaya will endeavour to provide advance notice of scheduled downtime where reasonably practicable.

9.2 Limitation of Liability

To the fullest extent permitted by applicable Philippine law, gotaya's aggregate liability to any Member for any claim arising out of or in connection with these Terms, the Platform, or any services provided shall not exceed the total net deposits made by that Member in the 30 days preceding the event giving rise to the claim. gotaya shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or loss of opportunity.

9.3 Disclaimer of Warranties

The gotaya Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. gotaya makes no warranty that the Platform is free of errors, viruses, or other harmful components, or that defects will be corrected in any specific timeframe.

If you have a complaint or dispute regarding the gotaya Platform, services, or any specific game outcome, you should first contact gotaya's support team at [email protected] with full details of your complaint. gotaya will investigate all complaints and endeavour to respond within five business days.

If your complaint is not resolved to your satisfaction through direct contact with gotaya support, you may escalate the matter to PAGCOR as the relevant regulatory authority overseeing gotaya's operations in the Philippines. gotaya will co-operate fully with any PAGCOR investigation or mediation process.

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes that cannot be resolved through the internal complaints procedure or PAGCOR mediation shall be subject to the exclusive jurisdiction of the courts of the Philippines.

gotaya reserves the right to amend, update, or replace these Terms and Conditions at any time. Material changes will be communicated to Members via email or through a prominent notice on the Platform at least seven days before the changes take effect, except where changes are required immediately by law or regulatory directive.

Your continued use of the gotaya Platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept the amended Terms, you must cease using the Platform and may request Account closure in accordance with Section 3.5.

12.1 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity or enforceability of the remaining provisions.

12.2 Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Responsible Gaming Policy, and any applicable Bonus Terms, constitute the entire agreement between you and gotaya with respect to your use of the Platform and supersede all prior agreements, representations, or understandings, whether written or oral.

12.3 No Waiver

gotaya's failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any subsequent occasion.
